Thank you for joining the testgenerator.app community! These Terms of Service outline your rights and responsibilities when using our platform.

1. User Conduct

By using our services, you agree to:

  • Not disrupt the normal operation of our services.
  • Not send spam or gain unauthorized access.

2. User Content & AI Services

Your Content: You retain ownership of any data, text, or inputs you upload to the Service ("User Input"). You grant us a worldwide, non-exclusive license to host, copy, and use your User Input solely to provide and improve the Service.

AI Output: Subject to your compliance with these Terms, we assign to you all our right, title, and interest in the content generated by the Service based on your User Input ("Output").

AI Disclaimer: The Service utilizes artificial intelligence. AI models may produce uncertain or inaccurate results. You acknowledge that Output may contain errors, biases, or inaccuracies. You are solely responsible for verifying the accuracy of any Output before using it. The Service is not a substitute for professional advice.

3. Subscription, Payments, and Refund Policy

PLEASE READ THIS SECTION CAREFULLY.

  • Right of Withdrawal (EU Consumers): Generally, EU consumers have a 14-day right of withdrawal. However, by purchasing a subscription for digital content (our Service), you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal once the service has started.
  • Non-Refundable Payments: To the extent permitted by applicable law, all subscription charges are final and non-refundable. We do not provide refunds for partial subscription periods.
  • Automatic Renewal: To ensure uninterrupted service, your subscription will automatically renew at the end of each billing cycle at the then-current rate, unless you cancel it before the renewal date.
  • Cancellation: You may cancel your subscription at any time through your account settings. Cancellation stops future billing but does not result in a refund for the current period.
  • Price Changes: We reserve the right to modify our pricing with prior notice. Continued use after the change takes effect constitutes acceptance.
  • Digital Services Conformity: We are obligated to supply digital services that conform to the contract. If a service issue arises, please use our complaint procedure defined below.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES. For consumers in the EU/Poland: This disclaimer does not affect your statutory rights regarding the conformity of goods/digital services with the contract.

5. Governing Law

These terms are governed by the laws of the jurisdiction in which we are incorporated (Poland).

6. Data usage and feedback

To improve our platform, we may analyze your usage data internally. We may also contact you for feedback or important updates. Our Privacy Policy provides further details on data practices and your rights.

7. Indemnification

You agree to indemnify and hold harmless AI Test Generator from claims arising out of your misuse of the Service or violation of these Terms. For consumers: This provision applies only to claims resulting from your culpable conduct.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU IN THE LAST 12 MONTHS.

For Polish Consumers: This limitation does not apply to damage caused intentionally or generally to personal injury, or where liability cannot be excluded by relevant consumer laws.

9. Termination

We reserve the right to suspend or terminate your access for a material breach of these Terms or for important reasons (such as security threats), upon reasonable notice where possible.

10. Complaints & Dispute Resolution

If you have a complaint, please contact us at support@testgenerator.app. We will respond within 14 days.

EU consumers can also use the Online Dispute Resolution (ODR) platform.

11. Changes to Terms

We may update these Terms. For consumers, material changes will be communicated via email or site notifcation, giving you the right to terminate the contract if you do not accept the new terms.
